The customs transit procedure implies that goods crossing the border of the Eurasian Economic Union (EAEU) are under customs control and are transported to the place of storage to ensure their safety. The security may be different: monetary funds, surety agreements, transportation of goods by a customs carrier, bank guarantees, customs escort, etc. Monetary security, property, etc. guarantee the state payment of customs duties and taxes even in case of loss of goods. The amount of security is equal to the amount of duties and taxes payable for the product when it is released for domestic consumption.
This procedure is usually applied when transporting goods from the EAEU border crossing point to a temporary storage location for customs clearance of imports. As a rule, this procedure is handled by transport companies, and ordinary users are unlikely to encounter it.
When processing customs transit, all prohibitions and restrictions on the import and export of goods are taken into account, with the exception of technical regulation measures. In other words, you will not be allowed to move goods in transit if they do not have veterinary certificates, phytosanitary certificates, licenses, etc.
The EAEU HS code is a code that is used when declaring goods. It is designed to identify goods for the purpose of collecting duties, controlling customs value, observing prohibitions and restrictions on goods, as well as for statistical accounting of foreign trade. The full HS code consists of 10 digits. For some products, the code may consist of 14 digits with additional digits to clarify the information. The declarant chooses the product code, but the correctness of the encoding is controlled by the customs authorities. The declarant’s task is to fully describe the goods in order to avoid additional questions from customs. The code is selected based on the product name and its characteristics. If the customs authorities determine that the declarant did not specify all the characteristics of the goods or incorrectly chose the HS code, this may lead to an increase in the amounts of duties and taxes or to the need to submit additional permits.
According to the Customs Code of the Customs Union, there are certain deadlines for customs clearance procedures at customs points. If temporary storage of the goods is necessary, it can be left at the customs office for no more than 2 months. In this case, it is possible to extend the deadline by written application, but not more than 6 months. Before the end of the maximum storage period, it is necessary to submit a declaration on the transported products.
The goods are released from the country within 1 business day after the successful completion of the permit procedures. In some cases, it is possible to apply a simplified registration procedure, the duration of which cannot be more than 3 days. This applies to perishable products, emergency relief supplies, military equipment, and other categories of goods.
